Medicare DMEPOS Supplier Standards

Note: This is an abbreviated summary of the Medicare Supplier Standards. The full text of each standard is at 42 CFR 424.57(c). Affinity Medical Services Inc is an accredited DMEPOS supplier and meets these standards.

Supplier standards

  1. Operates its business and furnishes Medicare-covered items in compliance with all applicable Federal and State licensure and regulatory requirements.
  2. Has not made, and will not make, any false statement or misrepresentation of a material fact on its enrollment application.
  3. Has an authorized individual whose signature is on the enrollment application.
  4. Fills orders, fabricates, or fits items from its own inventory, or by contracting with other companies for the purchase of items necessary to fill the order; does not contract with any entity currently excluded from Medicare, Medicaid, or other federal procurement programs.
  5. Advises beneficiaries that they may rent or purchase inexpensive or routinely purchased durable medical equipment, and of the purchase option for capped-rental equipment.
  6. Notifies beneficiaries of warranty coverage and honors all warranties under applicable State law, and repairs or replaces free of charge Medicare-covered items that are under warranty.
  7. Maintains a physical facility on an appropriate site and maintains a visible sign with posted hours of operation.
  8. Permits CMS or its agents to conduct on-site inspections to ascertain compliance with these standards.
  9. Maintains a primary business telephone listed under the name of the business locally or toll-free for beneficiaries.
  10. Has a comprehensive liability insurance policy in the required minimum amount that covers both the supplier's place of business and all customers and employees.
  11. Agrees not to initiate telephone contact with beneficiaries, with a few exceptions allowed by law.
  12. Is responsible for the delivery of, and continues to be responsible for, Medicare-covered items to beneficiaries and maintains proof of delivery.
  13. Answers questions and responds to complaints of beneficiaries, and maintains documentation of such contacts.
  14. Provides beneficiaries with information and instructions on how to use Medicare-covered items, and maintains proof of delivery.
  15. Maintains and replaces at no charge or repairs directly, or through a service contract with another company, any Medicare-covered item it has rented to a beneficiary.
  16. Accepts returns of substandard or unsuitable items from beneficiaries.
  17. Discloses these standards to each beneficiary it supplies a Medicare-covered item.
  18. Discloses any person having ownership, financial, or control interest in the supplier.
  19. Does not convey or reassign a supplier number; does not sell to or allow another entity to use its Medicare billing number.
  20. Has a complaint resolution protocol established to address beneficiary complaints, and maintains documentation of each complaint and its resolution.
  21. Provides to CMS, upon request, any information required by the Medicare statute and regulations.
  22. Complies with the disclosure provisions in 42 CFR 420.206.
  23. Is responsible for furnishing CMS-required information and maintaining ordering and referring documentation, including the National Provider Identifier of the ordering physician.
  24. Complies with all applicable accreditation requirements.
  25. Meets the surety bond requirements specified in 42 CFR 424.57(d).
  26. Obtains oxygen from a State-licensed oxygen supplier (where applicable).
  27. Maintains ordering and referring documentation consistent with provisions found in 42 CFR 424.516(f).
  28. Is prohibited from sharing a practice location with certain other Medicare providers and suppliers.
  29. Remains open to the public a minimum of 30 hours per week, with limited exceptions.
  30. Meets all applicable State licensure requirements for each State in which it operates.
